These terms and conditions of sale govern the purchase of products and services made through the Digi Softair website, managed by Digi Softair di Di Girolamo Giorgio, with registered office at Via Vestina n° 132/134, Montesilvano (PE) 65015, registered with the Pescara Business Register, VAT number 01894410685.

Acceptance of the General Terms and Conditions of Sale

. The contract concluded between Digi Softair and the Customer is considered finalized upon acceptance, even partial, of the order by Digi Softair. Such acceptance is deemed implicit unless otherwise communicated to the Customer in any manner. By placing an order through the various available methods, the Customer declares to have reviewed all the information provided during the purchase process and to fully accept the general terms and conditions of sale and payment detailed below.

. If the Customer is a consumer, once the online purchase procedure is complete, they must print or save an electronic copy and in any case retain these general terms and conditions of sale, in compliance with Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.

. The Customer is not entitled to any compensation for damages or indemnity, nor any contractual or non-contractual liability for direct or indirect damage to people and/or property caused by the partial or total non-acceptance of an order.

. Orders on the Digi Softair website may only be placed by individuals of legal age, as the contract is legally binding. Digi Softair will not be held responsible for the sale of products with restrictions (e.g., knives, crossbows for 18+, self-defense sprays, airsoft replicas for 16+, etc.).

. All items in our catalog comply with Italian legal standards unless otherwise specified. For orders and shipments to foreign countries (EU and non-EU), it is the buyer's responsibility to check the destination country's laws, as Digi Softair will not be held liable for any violations.

. Reviews are unverified, as they are accepted through Google or Meta (Facebook) and are not managed by our internal systems; therefore, verification is not possible.

. In accordance with the Omnibus Directive, we inform our customers that, as per the law, we may use automated profiling to offer personalized prices to certain consumers or consumer categories. We are available for further clarification on this practice.

. Digi Softair disclaims any liability for damage or injury resulting from the proper or improper use of any item or service provided by Digi Softair or any staff member. Users are responsible for using such items and services responsibly and at their own risk. Residents outside Italy must also verify the regulations of the destination country.


Purchase Methods

. The Customer may only purchase products listed in Digi Softair's electronic catalog at the time of placing the order and viewable online at www.DigiSoftair.com, as described in the corresponding product information sheets. It is understood that the images accompanying the product description may not perfectly represent its characteristics and may differ in color, logos, writing, dimensions, and included accessories. All additional purchase support information is to be understood as generic informational material and not indicative of the actual characteristics of an individual product; therefore, it cannot be a reason for return.

. Online sales prices may differ from those in physical stores, and discrepancies between package prices and website prices may occur. For e-commerce purchases, the website price prevails, while the label price applies to physical stores.

. Digi Softair confirms the correct receipt of the order via an email sent to the Customer's provided email address. This confirmation email will include the order date and time and a "Customer Order Number" for all subsequent communications with Digi Softair. The email reiterates all data entered by the Customer, who must verify its accuracy and promptly communicate any corrections as described in this document.

. Prices for products and ancillary services (e.g., shipping) may vary between European countries due to different tax rates. Digi Softair adheres to the OSS scheme, adjusting taxes accordingly.

OSS EU: Taxable persons established in Italy and registered with the OSS EU must declare service provisions to final consumers residing in a Member State other than Italy and cross-border distance sales of goods.

. In case of non-acceptance of the order, Digi Softair guarantees timely communication to the Customer.

Payment Methods

  • Payment Cards: Secure payments via the BNL BNP PARIBAS banking service, through Axepta Worldline.

  • Bank Transfer in Advance: For payments made via bank transfer in advance, Digi Softair commits to holding the product of your interest at a locked price for a few days, the time usually required to complete the currency transfer process.

Shipping will be at our discretion; you will be contacted to confirm, cancel, or pay the difference for the shipping cost.

We reserve the right to refuse shipments or propose adjusted shipping costs for countries with particularly high shipping expenses or challenging laws.

Delivery Times

  • Europe: Typically 3 days.

  • Rest of the World: Typically 5 days.

We are not responsible for delivery delays caused by the courier.

Once items are shipped, the destination address cannot be changed.


Additional Shipping Details

All orders in Italy are delivered via GLS courier. In Europe and the rest of the world, shipments will be made via GLS and DHL. Couriers require a signature upon delivery. We reserve the right to split shipments into multiple packages or change couriers without notice if deemed more convenient or suitable for certain areas.

Orders are delivered on working days, Monday through Friday. Delivery time cannot be chosen, though we can add a note for the courier at their discretion.

Digi Softair may exclude certain products (too large or heavy) from the "Free Shipping" promotion or add extra shipping costs.

Providing a valid phone number (mobile or landline) at the time of order is mandatory to confirm the order and allow the courier to contact you for delivery.

  1. Insurance and Conditions in Case of Loss or Damage of the Package:

If the package is delivered with our tamper-evident tape damaged or missing, and/or visibly opened or damaged, please "accept with reservation"; otherwise, it will not be possible to file a claim for damages to the contents of the package. (Please be careful when opening packages to avoid damaging the contents.)

WARNING: We do not assume any responsibility for shipments unless the insured shipping option is chosen (which only covers the value of the goods and does not include shipping and handling costs).

INSURE YOUR PACKAGE: and we will take responsibility for your shipment (cost €5.9).

If your package is lost or damaged during shipment, insuring it will entitle you to a replacement product identical to the one ordered. If it is not available, you will be offered a substitute product of equal value or a full refund.

The claim for compensation will only be accepted if you signed "with reservation" to the courier, or if the package is lost by the courier and therefore marked as undelivered.

If you choose not to insure your package, we will not be held responsible for the shipment, and you will be entitled to the basic courier refund, which amounts to €0.5 per kg based on weight/volume ratio (e.g., the packaging of an M4 replica weighs between 12 and 16 kg by weight/volume ratio), which would result in a refund of approximately €6/8. Digi Softair reserves the right to use or not use the courier's insurance and may choose to take full responsibility for the shipment, with all rights outlined above remaining in effect for customers.

Once the document is signed by the courier, the customer cannot raise any complaints regarding the external condition of the delivered item. Digi Softair reserves the right to request additional documentation from the customer to verify the actual damage.

We remind you that shipping costs are charged to the recipient unless otherwise agreed directly with the customer for specific reasons. Online purchases are official purchases. If you wish to cancel your purchase, you must notify us as soon as possible and no later than the date of shipment of the package. In case of refusal of the package upon delivery, you will be notified by email or phone so that the shipment can be redirected. If we do not receive a response by phone or email within 10 days, we will process the return shipment, and you will be charged the full cost of shipping, as well as the return fee and storage costs, as communicated to you.

Product Returns (Right of Withdrawal)

  • Pursuant to Article 64 and following of Legislative Decree No. 206/2005, if the customer is a consumer (i.e., an individual purchasing goods for non-professional purposes or not indicating a VAT reference in the order notes to digisoftair.com), they have the right to withdraw from the purchase contract for any reason within 14 days of receiving the goods.

  • Any product returns must always be accompanied by the completed return form, which should be included in the package and sent to our premises. Failure to observe this step will lead to a longer processing time for the return.

  • Alternatively, a registered letter with acknowledgment of receipt can be sent within 14 days from the date of receipt of the goods to: Digi Softair di Di Girolamo Giorgio, located at Montesilvano (PE) 65015, Via Vestina 132/134, or send an email with the order reference to resi.digisoftair@gmail.com. Digi Softair will then send the customer an email with instructions for the return.

  • The costs associated with the return are entirely the responsibility of the customer (shipping cost to our store + inspection and storage fees of €15 for orders within Italy and €30 for orders in Europe and outside the EU).

Return Conditions:

The right of withdrawal is subject to the following conditions:

  1. You have 14 days to request your return via email to resi.digisoftair@gmail.com and an additional 14 days from the request to ship the goods. If either of these two deadlines is exceeded, the right to request a return will no longer apply.

  2. The right does not apply to sealed products, batteries, or biodegradable consumables.

  3. The purchased item must be intact and returned in its original packaging, complete with all parts (including packaging and any documentation and accessories: manuals, cables, etc.); to avoid damage to the original packaging, we recommend placing it in a second box, affixing the label provided by Digi Softair, including the completed return form. Failure to observe this step will lead to significantly longer processing times. Labels or adhesive tapes should not be applied directly to the original packaging.

  4. The costs associated with the return (shipping + inspection and storage) are the responsibility of the customer.

  5. Products returned for incompatibility (not suitable for our product) or for warranty repairs but found to be functional and compatible, or tampered with, will be subject to a flat handling fee of €25.00, in addition to the return handling costs (see return conditions).

  6. In the case of payment by card, if the order is canceled before shipment, a 5% charge of the total amount will be applied to cover the incurred costs (other payment methods excluded).

  7. The shipment, until confirmed as received at our warehouse, is the full responsibility of the customer.

  8. In the event of damage to the item during transport, Digi Softair will notify the customer of the incident (within 5 working days from the receipt of the item at our warehouse) to allow them to promptly file a claim against the chosen courier and obtain a refund for the value of the item (if insured). In this case, the product will be made available to the customer for return, while canceling the withdrawal request.

  9. Digi Softair is not responsible for any damage or theft/loss of goods returned via uninsured shipping.

  10. Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not related to transport.

  11. Subject to any potential restoration costs for damages to the original packaging, Digi Softair will reimburse the customer for the amount already paid for the purchase of the goods within 14 days of their return, using the payment card charge reversal procedure or via bank transfer. In the latter case, it is the customer’s responsibility to provide the bank account details for the refund (IBAN and bank of the invoice holder).

  12. The right of withdrawal will be completely void if the essential condition of the item's integrity (packaging and/or content) is missing, in cases where Digi Softair finds:

  • The absence of the external packaging and/or the original internal packaging;

  • The absence of integral parts of the product (accessories, cables, manuals, parts, etc.);

  • Damage to the product due to causes other than transport;

  • Restoration of packaging or internal packaging is not possible;

  • The item has been disassembled and/or tampered with.

In the event of withdrawal right forfeiture, the merchandise will remain at Digi Softair's premises, available for pickup at the customer’s expense.

The refund to the customer may be partial if the goods have depreciated in value, such as:

  • Non-diligent use of the product;

  • Partial use of the item and any consumables;

  • Damaged or non-intact packaging as received.

WARNING: If a package is refused upon delivery, the shipping, payment handling, insurance, and all associated costs will remain the customer's responsibility for the full amount incurred (i.e., our actual incurred cost, including handling). Therefore, upon the return of the goods to our premises, the actual cost to be borne will be calculated and communicated.

If an electronic payment system was used, this amount (after prior communication) will be deducted from the refund. If the payment was made in cash upon delivery, you will be asked to pay the amount within a specified period, and if payment is not received, the case will be handed over to our lawyer for debt collection.

For transparency, we inform you that the maximum amount you would need to pay would be €50 for standard shipping within Italy and €70 for shipping outside Italy or to challenging locations and minor islands such as the Venice Lagoon, Livigno, Campione d'Italia, etc.

  1. Exchange of Goods:

A voucher will be issued linked to your account (if registered) or a shopping voucher (if ordered as a guest) within an acceptable timeframe for the transaction, with a maximum of 30 days from the return notification, provided that the goods have already been returned to our possession.

The shopping voucher issued will be for the same amount paid for the returned products, but the "free shipping" promotion will not apply to that amount; to benefit from it, the minimum threshold must be met again, over and above the value of the voucher.

Note, the voucher amount will be net of the costs associated with the return:

  1. Shipping costs for the return to our store (the customer must arrange the shipment themselves).

  2. Delivery costs different from standard (courier delivery to a customer-specified address, shipping insurance, etc.).

Refund:

A refund will be made in the indicated methods and within an acceptable timeframe for the transaction, with a maximum of 30 days from the return notification, provided that the goods have already been returned to our possession.

Note, the refund amount will be net of the costs associated with the return:

  1. Control and storage costs for orders shipped in Italy (in locations without special conditions) are €15, while for orders shipped in Europe or to remote locations and minor Italian islands, they will be €30.

  2. Delivery costs different from standard (courier delivery to a customer-specified address, shipping insurance, etc.).

  3. Shipping costs for the return to our store (the customer must arrange the shipment themselves).

In case of payment by card, if order cancellation is requested before shipment, a 5% charge of the total amount will be applied to cover incurred costs (excluding other payment methods).

For payments via bank transfer, a fee of €2 will be applied to cover costs.

Note: In the case of a refund, the customer is entitled to a full refund up to the fulfillment of the order (excluding package insurance). All return, control, and storage costs are to be covered by the customer.

Warranties

  • All products sold on Digi Softair are covered by the manufacturer's conventional warranty and a 24-month warranty for conformity defects, in accordance with Dlgs 24/02. The manufacturer's conventional warranty is provided according to the procedures outlined in the documentation inside the product packaging and available on www.digisoftair.com.

To use warranty assistance, the customer must keep the proof of purchase.

Exercising the warranty may involve contacting authorized service centers in the area and/or following the procedures outlined in the documentation inside the product packaging.

  • The manufacturer's conventional warranty is provided according to the procedures outlined in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is found not to be covered by the manufacturer's conventional warranty, the customer will be charged for any verification and restoration costs incurred by the Authorized Service, as well as transport costs if paid by Digi Softair.

  • The 24-month warranty under Dlgs 24/02 applies to a product that has a conformity defect, provided that the product is used correctly and in accordance with its intended purpose and the technical documentation provided. In the case of a conformity defect, Digi Softair will, at no cost to the customer, restore the product's conformity through repair/replacement or price reduction, up to the resolution of the contract. If, following intervention by an Authorized Service Center, the defect is found not to be a conformity defect under Dlgs 206/05, the customer will be charged for any verification and restoration costs incurred by the Authorized Service, as well as transport costs if paid by Digi Softair.

  • Replacements in case of DOA (Dead On Arrival: product not functioning at delivery) only occur if explicitly provided by the manufacturer. The time for replacement or possible repair of the product depends solely on the manufacturer's policies.

  • If, for any reason, Digi Softair is unable to provide the customer with a warranted product (repaired or replaced), Digi Softair may, at its discretion, refund the amount paid taking into account the use of the item or replace it with a product of equal or superior characteristics.

  • Repair or replacement times depend solely on the manufacturer's policies, and Digi Softair cannot be held liable for any damages due to delays in repair or replacement.

  • When applying the warranty requires product return, the product must be returned by the customer in its original packaging, complete with all its parts (including packaging and any documentation and accessories: manuals, cables, etc.). To avoid damage to the original packaging, we recommend placing it in a second box. Labels or adhesive tape should never be applied directly to the original packaging.

  • Signs of wear, discoloration, and any possible aesthetic marks due to use or simple handling cannot be considered defects (examples: a grip that loses color after handling, a metal buckle that loses color due to opening and closing the latch, or a knife blade that becomes less coated or blued after use. This can occur even after brief use).

  1. Contact us beforehand to ensure that the product is indeed non-functional, NEVER tampered with, and that the issue is due to defects attributable to the product and not to incompatibility not related to the product or consumables not covered by warranty.

Applicable Law

The sales contract between the customer and Digi Softair is concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, the exclusive jurisdiction is the Court of Pescara, Italy.
